LIBERTY GARAGE SUPPLY TERMS OF SERVICE & SALES AGREEMENT

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING THIS WEBSITE, PLACING AN ORDER, OR PURCHASING AUTOMOTIVE EQUIPMENT FROM LIBERTY GARAGE SUPPLY LLC, YOU AGREE TO BE BOUND BY ALL TERMS, CONDITIONS, DISCLAIMERS, AND POLICIES SET FORTH HEREIN.

1. OVERVIEW & BUSINESS STRUCTURE

This website and e-commerce portal is operated by Liberty Garage Supply LLC ("Company", "we", "us", or "our"). Liberty Garage Supply LLC operates as an independent distributor and authorized retail dealer of commercial and residential automotive lifts, garage equipment, tool storage systems, and industrial accessories. All products, services, tools, and content provided through this site are conditioned upon your ("Customer", "User", "Purchaser") acceptance of these Terms of Service.

2. E-COMMERCE & ORDERING TERMS

By placing an order on our site, you represent that you are at least the age of majority in your state or jurisdiction of residence and possess the legal authority to enter into binding purchase agreements. We reserve the right to refuse service, cancel orders, or terminate accounts at our sole discretion, including but not limited to instances of suspected fraudulent activity, unauthorized dealer purchasing, or pricing errors.

3. FREIGHT SHIPPING, DELIVERY & INSPECTION POLICY

Due to the size and weight of automotive lifts and heavy garage equipment, specialized Motor Freight (LTL / Less-Than-Truckload) carrier protocols apply:

Delivery Destinations: Shipments may be delivered to a local freight carrier terminal near the Purchaser for customer pickup, or delivered directly to the Purchaser’s residential or commercial address. Direct address shipments are strictly standard Curbside Delivery; freight drivers are not responsible for offloading equipment into residential garages, commercial bays, or indoors.
Unloading Responsibility & Lift-gate Restrictions: For home or business direct deliveries, the Purchaser is solely responsible for providing adequate offloading equipment (e.g., forklift or tractor with forks) on-site at the time of delivery. Due to weight restrictions, vehicle lifts are strictly ineligible for lift-gate delivery. Where lift-gate services are applicable on eligible non-lift items and requested, additional carrier fees may apply.
Terminal Pickup & Storage: For terminal deliveries, the Purchaser must collect the shipment within 48 business hours of carrier notification, after which any accrued daily storage fees become the Purchaser's sole financial responsibility. Freight remaining uncollected after five business days will be classified as abandoned, making the Purchaser liable for all return shipping charges, terminal storage fees, and a 25% restocking fee deducted from any applicable refund.
Mandatory Pre-Sign Inspection: Purchaser MUST thoroughly inspect all crates, packaging, and equipment for visual damage, structural compromise, or missing items BEFORE signing the carrier's Delivery Receipt / Bill of Lading (BOL).
Freight Damage Claims:
- If equipment arrives significantly damaged, Purchaser MUST refuse the shipment and immediately contact Liberty Garage Supply LLC.
- If minor damage or missing items exist, Purchaser MUST note the exact damage on the carrier's BOL before signing. Failure to note damage on the BOL releases Liberty Garage Supply LLC and the carrier from liability for shipping damages.
Delivery Access & Additional Carrier Fees: The carrier may contact the Purchaser to schedule a delivery appointment window. Any storage, redelivery, re-consignment, or demurrage fees resulting from customer unavailability, restricted site access, or lack of unloading equipment are the sole financial responsibility of the Purchaser.

4. PRICING, BACKORDERS & MANUFACTURER MAP COMPLIANCE

Liberty Garage Supply LLC strictly adheres to all Minimum Advertised Price (MAP) standards established by our manufacturing partners. All prices are listed in USD.

Price Adjustments & Backorders: Occasionally, manufacturer pricing may change before a backordered or special-order product ships.If a price adjustment occurs while an item is on backorder, Purchaser will be notified prior to charge processing and given the option to confirm or cancel the order without penalty.
Pricing Errors: In the event a product is listed at an incorrect price due to typographical error or manufacturer data feed inaccuracy, Liberty Garage Supply LLC reserves the right to cancel or refuse any orders placed at the incorrect price.

5. RETURNS, RESTOCKING & CANCELLATION POLICY

Purchases are subject to our formal Return & Cancellation Policy:

Cancellations: Orders canceled prior to shipment or production fulfillment are subject to payment processing fee deductions (up to 3%). Special-order or custom-manufactured lifts cannot be canceled once production has commenced.
Returns: Eligible standard stock equipment may be returned within 30 days of delivery, provided the item is brand new, unused, uninstalled, and in its original manufacturer packaging with all original components, accessories, manuals, and hardware.
Restocking & Shipping Costs: All approved returns are subject to a standard 20% restocking fee. The Purchaser is responsible for all original outbound freight charges as well as return freight shipping costs.

6. EQUIPMENT INSTALLATION & SAFETY DISCLAIMER

CRITICAL SAFETY NOTICE: Automotive lifts and heavy shop equipment require strict adherence to manufacturer concrete slab specifications, electrical standards, hydraulic safety measures, and anchoring requirements.

Liberty Garage Supply LLC is a distributor and does not perform direct equipment installations or structural engineering assessments. It is the Purchaser's sole responsibility to ensure that the installation site (including floor thickness, concrete strength rating, and electrical supply) complies with manufacturer guidelines and local building codes. Installation by a certified Automotive Lift Institute (ALI) professional installer is strongly recommended. Liberty Garage Supply LLC assumes no liability for damages, injuries, or property loss resulting from improper self-installation, unanchored operation, or unauthorized equipment modifications.

ASSUMPTION OF RISK: Automotive lifts and heavy equipment are inherently dangerous. Purchaser acknowledges and agrees that the installation, operation, maintenance, and use of heavy automotive equipment carry severe risks, including property damage, catastrophic bodily injury, or death. Purchaser expressly, knowingly, and voluntarily assumes all risks associated with the ownership, installation, self-installation, unanchored operation, modification, maintenance, or use of the equipment. Liberty Garage Supply LLC assumes no responsibility or liability for damages, injuries, or loss of life resulting from improper installation, failure to adhere to safety protocols, or unauthorized equipment modifications.

7. MANUFACTURER WARRANTIES

Products sold by Liberty Garage Supply LLC are covered exclusively by the respective original manufacturer warranties (e.g., structural, hydraulic, and electrical component warranties). Liberty Garage Supply LLC makes no independent or secondary warranties, express or implied. All warranty claims, replacement part requests, and service inquiries must be submitted through our customer support team to be routed to the appropriate manufacturer department.

8. LIMITATION OF LIABILITY & INDEMNIFICATION

LIMITATION OF LIABILITY: To the fullest extent permitted by law, Liberty Garage Supply LLC, its members, managers, officers, employees, agents, and affiliates shall not be liable under any legal theory (contract, tort, negligence, strict product liability, or otherwise) for any direct, indirect, incidental, punitive, consequential, or special damages—including but not limited to personal injury, severe bodily harm, wrongful death, property damage, lost shop income, rental equipment expenses, project delays, or business interruption—arising out of or related to the sale, delivery, installation, operation, failure, or use of any product sold.

INDEMNIFICATION: Purchaser agrees to defend, indemnify, and hold harmless Liberty Garage Supply LLC and its members, managers, officers, employees, and agents from and against any and all claims, demands, lawsuits, liabilities, damages, losses, expenses, or costs (including reasonable attorney fees and court costs) brought by Purchaser, Purchaser’s employees, agents, contractors, customers, or any third party resulting from or arising out of:

Purchaser's breach of these Terms of Service;
Improper site preparation, concrete failure, improper equipment installation, unanchored operation, or unauthorized equipment modification;
Failure to follow manufacturer operating procedures, safety guidelines, or scheduled maintenance; or
Any personal injury, bodily harm, death, or property loss connected to the installation or operation of the equipment.

9. GOVERNING LAW & DISPUTE RESOLUTION

These Terms of Service and any purchase agreements entered into with Liberty Garage Supply LLC shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action, dispute, or proceeding arising under or relating to these terms shall be brought exclusively in the state or federal courts located in Hillsborough County, Florida.

10. SEVERABILITY & ENTIRE AGREEMENT

Severability: If any provision, clause, or portion of these Terms of Service is determined by a court of competent jurisdiction to be unlawful, invalid, void, or unenforceable, that provision shall be enforced to the maximum extent permissible under applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity, legality, or enforceability of any remaining provisions, which shall remain in full force and effect.

Entire Agreement: These Terms of Service, along with any formal order confirmations and posted site policies, constitute the complete, final, and exclusive agreement between the Purchaser and Liberty Garage Supply LLC regarding the purchase, delivery, and use of all products. These Terms supersede and replace all prior or contemporaneous communications, proposals, representations, email exchanges, or agreements—whether oral, written, or electronic—between the parties. No modification, waiver, or amendment of these Terms shall be binding unless executed in writing by an authorized representative of Liberty Garage Supply LLC.
